L’approche des droits fondamentaux pour une meilleure protection de l’environnement: le Conseil de l’Europe au banc d’essai 

Abstract : The Council of Europe is considering the adoption of an international convention on the right to the environment. This communication focuses on this project and deals with the issue of the protection of nature through fundamental rights. Should we opt for an individual right to the environment or for a right of mankind to the environment? And should we opt for an additional protocol to the European Convention on Human Rights or for a convention that could also be open to non-member states of the Council of Europe? If the recognition of an individual right to a healthy environment in an additional protocol to the ECHR is of interest, the consecration of a collective right of mankind to a viable environment in an open agreement is more promising.
