La Charte européenne pour l’égalité des femmes et des hommes dans la vie locale : genèse transnationale et usages territorialisés d’un instrument de soft law 

Abstract : Drawing on the case study of the European Charter for Equality of Women and Men in Local Life, this article highlights how processes of Europeanisation of law and territorialisation of public action are combined. The study of the genesis and uses of this charter reveals the interplay between different scales of government—transnational, national and local—in the European area. The Charter consists of a set of measures that are designed to fight against gender inequalities at a local level. The implementation of this Charter reveals an increased use of soft law—rules with limited legal value—by local governments, as well as the rise of gender mainstreaming, i. e. the integration of a gendered dimension in all local policy fields. The article first investigates the logics underlying the creation of the Charter, which is the product of negotiations between representatives of the national branches of the European Council of Municipalities and Regions. Then, it characterizes the signatory communities and analyses their distribution in the European space. Although the transnational and politically-neutral origins of the Charter make it appear ecumenical, the vote on its signature is part of a power struggle within the local authorities. Finally, this paper analyses the local reforms related to the application of this soft law instrument, which are often limited.
